This policy outlines how personally identifiable information and other personal data will be collected, used, and shared in connection with access to and/or use of the Global Background Screening platform, public website, and any content, features, services, or other offerings that Global Background Screening provides in connection with its services.
GLOBAL BACKGROUND SCREENING, LLC GLOBAL EU-US, SWISS-US, AND UK EXTENSION DPF DATA PRIVACY FRAMEWORK PRIVACY POLICY
Global Background Screening, LLC (“GBS, ”Global Background Screening,” “we,” us,” or “our”) complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. GBS has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles), with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. GBS has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Global Background Screening also complies, where applicable, with U.S. law. In the event of a conflict between this DPF Privacy Statement and other applicable laws, GBS will comply with its obligations under the applicable law. GBS's DPF Privacy Statement is organized around the following principles:
Notice
GBS will use the personal information it obtains in connection with the purpose established or for legal requirements. Personal information may pertain to consumers, clients, business prospects, vendors, employees, prospective tenants and job applicants.
Consumer Information
GBS receives information on consumers from its clients, vendors, or other entities (courts, law enforcement agencies, educational institutions, employers, etc.) in the performance of services for and under its clients' direction. Where GBS is the recipient of personal information, it will use the information following the purpose indicated with the notices provided by such entities and the consent choices made by the individuals to whom such personal information relates. GBS's client types include employers, financial institutions, property owners or other background screening agencies, etc. Most services are for employment-related decisions. GBS plays no part in making any decision related to how our clients use the consumer information GBS provides in the performance of the services ordered.
A person may request, in writing, access to all personal information collected and maintained about him or her by GBS. Upon receipt of such request, GBS will provide all such information in a manner and form that maintains the security and confidentiality of the information. GBS affords the person a reasonable opportunity to correct, amend, or delete information that is inaccurate or incomplete, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy, or where the rights of persons other than the individual would be In cases where the information is subject to the FCRA, GBS complies with the FCRA’s requirements regarding access and correction rights of consumers. To request information relating to his or her personal information, the party may contact GBS by e-mail at the following email address, info@getgbs.com. In addition, the consumer will be asked to provide sufficient evidence of his or her identity so we may ensure that information is being released only to the subject of the data. If we are unable to provide the consumer with access to his or her EU, Swiss, or United Kingdom Personal Data or to correct the data, we will notify the consumer and provide all relevant details and circumstances preventing GBS from doing so.
Business Contact Information
GBS may use the personal information of business prospects, clients, and vendors to establish, execute, and terminate a contract. Including completion of due diligence checks related to the business relationship. GBS may provide personal information to financial institutions to process payments.
Employee and Job Applicant Information
GBS may collect and use information from employees and job applicants to perform its human resource functions.
Choice
In many cases, the reports that we prepare are prepared with the express consent of the individual. For example, the subject of a consumer report issued for employment purposes must provide express authorization (“opt-in”), typically through the employer or prospective employer, before GBS may furnish the report. In other cases, GBS offers individuals the opportunity to choose (opt-out) whether their personal data is (i) to be disclosed to a third party (other than our service providers performing tasks on GBS’s behalf pursuant to a contract or a customer on whose behalf we are processing it) or (ii) to be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by the individuals.
For sensitive information (defined at the end of this section), GBS only obtains (directly or through the customer) affirmative express consent (opt-in) from individuals, with certain exceptions permitted by the DPF program, if such information is to be (i) disclosed to a third party or (ii) used for a purpose other than those for which it was originally collected or subsequently authorized by the individuals through the exercise of opt-in choice.
We are committed to providing individuals with clear, conspicuous, and readily available mechanisms to exercise choice. Therefore, in addition to any other mechanisms that may be provided in particular cases, individuals may opt-out by choosing so on their authorization form invite or simply by contacting GBS using the points of contact in the “Contact Us” section below.
Sensitive information for purposes of this policy means personal data specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, information specifying the sex life of the individual or information designated by the transferring organization as sensitive. In the case of information transferred pursuant to the Swiss DPF, sensitive information also includes information on social security measures or administrative or criminal proceedings and sanctions, which are treated outside pending proceedings.
Accountability For Onward Transfer
Global Background Screening, LLC discloses personal data that it collects to the customer that requested it. GBS may disclose personal data to its service providers. GBS also may be required to disclose personal data in response to lawful requests by public authorities, including disclosures to meet national security or law enforcement requirements. GBS's disclosure of personal data to third parties is governed by the Notice and Choice Principles described above.
When transferring personal data to our customers or other third-party controllers (i.e., entities that will control how personal data is processed), we comply with the Notice and Choice Principles as described above. Consistent with DPF timing requirements for onward transfer compliance, GBS will enter into a contract with our customer that provides that such data may only be processed for limited and specified purposes consistent with the consent provided by the individual, that the recipient will provide the same level of protection as the Principles, and the recipient will notify the GBS if it makes a determination that it can no longer meet this obligation. The contract shall provide that when such a determination is made, the third-party controller ceases processing or takes other reasonable and appropriate steps to remediate.
As noted above, GBS also may transfer personal data to service providers acting on its behalf. In such cases, consistent with DPF timing requirements for onward transfer compliance, GBS will:
a transfer such data only for limited and specified purposes;
ascertain that the service provider is obligated to provide at least the same level of privacy protection as is required by the DPF Principles;
take reasonable and appropriate steps to ensure that the service provider effectively processes the personal data transferred in a manner consistent with GBS's obligations under the Principles;
require the service provider to notify the organization if it makes a determination that it can no longer meet its obligation to provide the same level of protection as is required by the Principles;
upon notice, including under (iv), take reasonable and appropriate steps to stop and remediate unauthorized processing; and
provide a summary or a representative copy of the relevant privacy provisions of its contract with that service provider to the Department of Commerce upon.
Security
GBS is committed to protecting personal information. GBS utilizes a combination of online and offline security technologies, procedures, and organizational measures to help safeguard consumer information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Data Integrity and Purpose Limitation
In accordance with applicable law, GBS takes reasonable steps to ensure that information is accurate, complete, current, and reliable for its intended use. GBS only collects data that is necessary for the purposes listed under the Notice section.
GBS takes reasonable and appropriate measures to retain personal data only for as long as GBS has a legitimate legal or business need, such as compliance with legal or contractual retention obligations, retention for audit purposes, customer service, security and fraud prevention, preservation of legal rights, or other reasonable purposes consistent with the purpose of the collection of the information.
GBS makes every effort to ensure that the data it collects and stores is as accurate as possible. GBS cannot guarantee; however, that third parties are accurate in their information. Therefore, GBS denies any responsibility for the accuracy of the data supplied by any third-party sources of information or by GBS’s clients.
GBS will adhere to the Principles for as long as it retains personal data transferred in reliance upon the DPF.
Access
It is GBS's policy to provide individuals with access to personal data about them that GBS holds about them and provides them with a means to request the correction, amendment, or deletion of that information where it is inaccurate, or has been processed in violation of the Principles, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the rights of persons other than the individual would be violated.
Pursuant to the DPF Frameworks, EU, UK, and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, delete that information where it is inaccurate, or has been processed in violation of the Principles, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the rights of persons other than the individual would be violated.
An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under DPF, should direct their query to info@getgbs.com. If requested to remove data, we will respond within a reasonable timeframe.
GBS requires that an individual provide reasonable verification of their identity before we provide access to personal data. To access your GBS file and obtain any of the remedies discussed in this section please contact GBS using the point of contact in the “Contact Us” section below.
Recourse, Enforcement and Liability
Global Background Screening internally monitors and assesses our compliance with our DPF Privacy statement and our DPF obligations. Under the DPF Principles, GBS may be liable in the event that a service provider to whom GBS transfers personal data such personal data in a manner inconsistent with the Principles, unless the organization proves that it is not responsible for the event giving rise to the damage. An individual with an inquiry or complaint may contact us using the mailing or email address below.
In the case of human resources data from the EU, GBS has agreed to cooperate with a panel of European Data Protection Authorities created for that purpose. In the case of human resources data transferred from Switzerland, GBS has agreed to cooperate with the Swiss Federal Data Protection and Information Commissioner. In the case of human resources data transferred from the United Kingdom, GBS has agreed to cooperate with the UK Information Commissioner’s Office (ICO).
If your complaint involves human resources data and non-human resources data transferred to the United States from the European Union, the United Kingdom, or Switzerland, and GBS does not address it satisfactorily, GBS commits to cooperate with the panel established by the EU data protection authorities (DPA Panel), the UK Information Commissioner’s Office, and the Swiss Federal Data Protection and Information Commissioner and to comply with the advice given by the DPA panel, ICO, or FDPIC, with regard to such human resources data and non-human resources data.
To pursue an unresolved human resources complaint, you should contact the state or national data protection or labor authority in the appropriate jurisdiction. Contact details for the EU data protection authorities can be found at https://edpb.europa.eu/about-edpb/board/members_en.
In compliance with the EU-US Data Privacy Framework Principles, GBS commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. With respect to personal data received or transferred pursuant to the DPF Frameworks, GBS is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.

Log Files
The private Global Background Screening client portal is secure and only available to authorized client users. Global Background Screening logs information about a user’s IP address, browser type and the current URL, and logs usage throughout the site for security purposes. These log files are stored in a secure location and used in our internal analysis of user logs within our system.
Personal Information Collected for the Purpose of Employment Screening and/or Business Due Diligence
You may be asked for your personal information by a potential employer or business partner in order to facilitate background screening for the purpose of employment or due diligence. This personal information may be relayed or directly input by yourself to Global Background Screening for collection as part of contracted services.

All personal information collected is relevant and necessary for Global Background Screening to perform our obligations thereon.
Any personal data categorized as ‘special data’ under the GDPR will require the data controller (typically an employer) to either have explicit consent from the individual with notice that processing is necessary for the purposes of carrying out the obligations and exercising specific rights of the controller or of the data subject in the field of employment or business due diligence.
Employee and Applicant Information
Global Background Screening may collect information from employees and job applicants to perform background screening functions. Individuals will be informed of the purposes for which Global Background Screening collects and uses the personal information.
Global Background Screening will provide the Individual with the choice and means, if any, for limiting the use and disclosure of their personal information when required, in accordance with federal and state laws. Disclosures or notices will be provided in clear and conspicuous language when individuals are first asked to provide personal information to Global Background Screening, or as soon as practicable thereafter, and in any event before Global Background Screening uses or discloses the information for a purpose other than for which it was originally collected. Employee and/or applicant information will never be used for any purpose other than it was originally intended, will not be sold, and never be used for marketing purposes. It will only be shared with third parties when necessary and as needed for the completion of background check services.
Consumer Information
Global Background Screening may disclose personal information on consumers to third parties in connection with the business transaction and purpose for which it was collected. Third party disclosure of the personal information may include the requesting client company, institutions, employers, courts, law enforcement agencies, third party agents, and other persons, businesses or government agencies as necessary for Global Background Screening to complete background check services.
Global Background Screening does not sell or market to the personal information of job applicants, employees or data report subjects.
We review our retention periods for personal information on a regular basis. We are legally required to hold some types of information to fulfill our statutory obligations. We will hold your personal information on our systems for as long as is necessary for the relevant activity, but not longer, or as long as is set out in any relevant contract held with us.
We will retain the personal information we process on behalf of our Clients for as long as required by law and as long as required to provide services to our clients. Global Background Screening will retain this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. While Global Background Screening has implemented technical, physical and administrative security measures to help protect against the loss, theft, misuse and unauthorized access of your information that we collect from you on behalf of our Clients, we cannot guarantee that our Clients will in like manner follow the terms set forth within this privacy policy and can therefore not be held liable for a Client’s actions.
Who has access to your information?
We will not sell or rent your information to third parties.
Third Party Service Providers working on our behalf:
We may pass your information to our third-party service providers, agents, sub-contractors and other associated organizations for the purposes of completing tasks and providing services to you or on your behalf (for example to process payments or provide a specific record check). However, when we use third party service providers, we disclose only the personal information that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own direct marketing purposes.
Please be assured that we will not release your information to third parties beyond the Global Background Screening network for them to use for their own direct marketing purposes.
Information sources outside of the United States may be contacted, at the client’s request, in order verify information claimed by an applicant which took place outside of the United States. All personal information will be transmitted and stored in a secure manner in accordance with the terms of this Privacy Notice. In the case of international searches, personal information may be transferred to other countries, including countries that have inadequate privacy laws according to the European Commission or other data protection commissions and/or government authorities.
We may transfer your personal information to a third party if we’re under a duty to disclose or share your personal data in order to comply with any legal obligation or to enforce or apply our terms of use or to protect the rights, property or safety of our customers. However, we will take steps with the aim of ensuring that your privacy rights continue to be protected.
Your rights
There are laws and regulations designed to protect PII in digital form. Examples of laws include the, the US Health Insurance Portability and Accountability Act (HIPAA), the Privacy Act in Australia, the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, and the General Data Protection Directive in the European Union.
In addition to the company’s safeguards that meet these standards, personal data of EU citizens is protected by the General Data Protection Regulation (GDPR).
Global Background Screening confirms that the data we hold about you will be processed lawfully and fairly. It will be kept securely to prevent unauthorized access by other people.

Right to Access Your Information
The General Data Protection Regulation (GDPR) provides EU citizens with the right to access any information held about you. You can assert this right at any time. We will provide a copy of your information, free of charge.
However, we do reserve the right to charge a ‘reasonable fee’ when a request is manifestly unfounded or excessive, particularly if it is repetitive. We also reserve the right to charge a reasonable fee to comply with further copies of the same information. Any fee will be based on the administrative cost of providing the information. We will endeavor to supply this information without delay and at the latest within one month of receipt. If the request is complex or numerous we can extend this period by a further two months. You will be informed, if this is the case, within one month of the request with an explanation as to why it is necessary.

Transferring your information outside of the United States
As part of the services offered from Global Background Screening for international criminal, education or employment purposes, the information which you provide to us may be transferred to countries outside the United States. These countries may not have similar data protection laws to the United States. By submitting your personal data, you’re agreeing to this transfer, storing or processing. If we transfer your information outside of the US in this way, we will take steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this Policy. If your data is transferred outside of the US it will be done so to allow us to perform any contractual obligations that are required to provide the services, you or (your employer/potential employer) has requested from us.
Our websites are scanned on a regular basis for known vulnerabilities including regular malware scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have authorized access to such systems and are required to keep the information confidential. Global Background Screening cannot ensure or warrant the security of any information you transmit to us by e-mail, and you do so at your own risk.
Where we have given (or where you have chosen) a password which enables you to access certain parts of our websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone and we also recommend you change your password regularly.
Security breach notification
Global Background Screening shall give notice to each organization administrator when the organization’s user information was, or it is reasonably believed to have been, inappropriately accessed as a result of a security breach. Said notice shall be made immediately upon confirmed discovery of the breach (including fulfilling our obligation under the GDPR to notify the ICO within 72 hours) and the time necessary such as to allow Global Background Screening to determine the scope of the breach, to identify organizations and individuals affected by the breach, and to restore reasonable integrity of the data system that was breached.

Additional Information for Canadian Users
This Policy applies to customers, users and applicants in both Canada and the United States. However, to the extent that this Policy is inconsistent with any applicable Canadian laws, Global Background Screening will comply with the applicable law for customers, users and applicants in Canada. For example, Global Background Screening will only send commercial electronic messages to persons located in Canada with explicit, opt-in consent, unless otherwise permitted pursuant to Canadian legislation that is applicable to such activities.
Applicants who are located in Canada should also understand that the nature of the Services will involve Global Background Screening obtaining potentially sensitive personal information about them, including consumer reports, criminal record, driving record, as well as education and employment records, from third parties such as consumer reporting agencies, police services and government agencies (e.g., provincial transportation ministries).
Global Background Screening will also share Applicants’ personal information with a third party service provider in Canada, for the purpose of completing or facilitating the background checks described in this Policy.
In addition, personal information that is collected in the course of providing the Services will be transferred outside Canada. Therefore, such information may be accessible to law enforcement and national security authorities in the jurisdiction(s) where it is stored or processed.
Canadian customers, users and applicants will be notified of any material changes to this Policy, where such change would result in use or disclosure of their personal information by Global Background Screening in a manner not contemplated by this Policy or reasonably expected by the individual.

Accountability
Global Background Screening ("GBS") has established a regularly reviewed privacy management program.
Purpose, Consent, Limiting Collection
GBS collects and uses the personal information of clients, vendors, business prospects, employees, job applicants, and consumers. The information obtained by GBS will be used for the purpose for which it was collected or for legal requirements. GBS only collects data that is reasonable for the purposes listed under this section. Individuals may withdraw consent, where an individual chooses to withdraw consent, processing will be stopped within a reasonable time. When consent is withdrawn, information is not necessarily erased or deleted.
Consumer Information
GBS receives information on consumers from its clients, vendors, or other entities (courts, law enforcement agencies, educational institutions, employers, etc.) within Canada in the performance of services for and under the direction of its clients. Where GBS is the recipient of personal information, it will use the information in accordance with the purpose indicated and the consent choices made by the individuals to whom such personal information relates. GBS’s client types include employers, financial institutions, insurance companies, other background screening agencies, etc. Most services are requested for the purposes of employment-related decisions, credit granting, and license applications. GBS plays no part in making any decision related to how our clients use the consumer information GBS provides in the performance of the services ordered.
Client, Business Prospect & Vendor Information
GBS collects and uses the personal information of clients to process orders. GBS may use the personal information of business prospects, clients, and vendors in order to establish, execute, and terminate a contract. Business prospects can be contacted during the contract preparation process using the information that they have provided. Personal data can be processed to prepare bids or to fulfill other requests of the prospect that relate to contract conclusion. This includes notices and advisory services for the client under the contract if this is related to the contractual purpose. Personal information may be provided to financial institutions to process payments. To ensure that subject information is safeguarded, personal information may be used to complete due diligence checks to ensure that subject data is only provided to third parties that have been appropriately verified and credentialed.
Employee and Job Applicant Information
GBS may collect and use information from employees and job applicants to perform its human resource functions. Where GBS is the recipient of personal information, it will use the information in accordance with the purpose indicated and the consent choices made by the individuals to whom such personal information relates.
Safeguards, Limiting Use, Disclosure, and Retention
GBS is committed to protecting personal information. While GBS cannot guarantee the security of the information, GBS utilizes a combination of online and offline security technologies, procedures and organizational measures, including limiting and monitoring employee access to personal information to help safeguard consumer information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction.
GBS takes reasonable and appropriate measures to retain personal data only for as long as GBS has a legitimate legal or business need, such as compliance with legal or contractual retention obligations, retention for audit purposes, customer service, security and fraud prevention, preservation of legal rights or other reasonable purposes consistent with the purpose of the collection of the information.
GBS discloses personal data that it collects to third parties in connection with the business transaction for which it was collected. Third-party disclosure of the information may include the GBS’s client whom the consumer has authorized to receive such information, and the third-party representative of GBS authorized to receive such information (e.g., affiliate companies, agents, in-country sources, educational institutions, employers, courts, law enforcement agencies and other persons or entities that may provide or verify information as necessary for GBS to process the authorized transaction).
